The Punjab-Haryana High Court has made it clear that accusing the spouse of illicit relationship without any proof is cruelty to him and his family. The decision of the family court of Moga given on the basis of this is absolutely correct.
While filing the petition in the family court, the husband had told that he was married in 2011. Shortly after the marriage, he came to know that his wife was angry.
In 2013, she left her in-laws' house and went to her maternal home. After the panchayat she returned home, but after a few days again she started repeating the old antics. The wife alleged that the husband had an illicit relationship with his sister-in-law.
After the hearing, the family court had ordered a divorce, while giving a verdict in favor of the husband. Challenging this order, the wife filed a petition in the High Court. The High Court said that making such an allegation without any proof amounts to cruelty to the spouse.
Divorce was ordered on the basis of this cruelty which is absolutely right. With these comments, the petition challenging the order of the Family Court by the wife was dismissed.
