Actually Indian constitution does not allow any foreigner to contest elections in India. Proper provisions have been made for this. Even if Seema gets Indian citizenship, there is one more condition which she does not fulfill.

What about Lok Sabha, Seema can't even contest assembly elections

The first condition for contesting elections in India is that the candidate should be an Indian citizen. If a person is not a citizen of India then he cannot contest elections. According to the website of the Election Commission, Article 84(a) of the Indian Constitution describes it in detail. It is written in this that no person can be elected to the Parliament unless he is a citizen of India. There is a similar provision for the State Legislatures as well, for this it has been mentioned in Article 173 (a) of the Constitution. According to this also Seema is ineligible to contest elections.

Ineligible even after getting citizenship

Even if Seema Haider gets Indian citizenship, she will still be considered ineligible to contest elections, in fact the minimum age for contesting elections in India is 25 years, according to Section 36(2) of the Representation of the People Act, 1950 and the Constitution. According to Article 173 (b), it is necessary for a candidate to complete at least 25 years of age to contest elections to Parliament and Legislative Assembly, Seema does not even fulfill this condition.

Seema is just 21 years old

Seema Haider's age is just 21 years, in fact, the Pakistani passport she has, Seema's age is recorded as January 1, 2002. According to this, when the Lok Sabha elections will be held in 2024, then Seema Haider's age will be only 22 years. Although Seema argues that she had written her age 6 years less in the passport, but according to the constitution, this argument will also not be valid, because while getting Indian citizenship, the same age of Seema will be valid as recorded in the passport of the country of origin. Is.

Who is considered a citizen of India

A person who was born in India before 1 July 1987 is considered an Indian citizen, but a person born after that is considered an Indian citizen only if one of his parents is a citizen of India. A child born abroad after 1992 must also have either of his mother or father to be an Indian citizen to get Indian citizenship.

A woman who came from Pakistan has contested elections

Neeta Kanwar, who came to India after being displaced from Pakistan, has contested elections here, she contested for the post of Sarpanch in 2020 from Natwada Gram Panchayat of Tonk district of Rajasthan. She came to India from Sindh province of Pakistan and settled in Jodhpur in 2001, she got Indian citizenship in 2019 after 18 years.
