A magisterial court in Mumbai has dismissed the closure report filed by the police in a rape case against Bhushan Kumar, the son of late Gulshan Kumar and Managing Director (MD) of T-Series Company. The court has said that during the investigation, various legal aspects have been compromised.The provisions of the law were misusedThe court said that the complainant woman has misused the provisions of the law by supporting the Final Report (B-Summary) which is meant for the needy. The court has directed the police to investigate the matter as per law and the Zonal Deputy Commissioner of Police (DCP) to supervise the investigation.allegations due to misunderstandingMetropolitan Magistrate RR Khan dismissed the report earlier this month and the detailed order was made available on Monday. After receiving the 'B Summary' notice, the woman filed an affidavit before the court, stating that she was an actress and had leveled the allegations against Bhushan Kumar due to 'circumstantial misunderstanding', and is withdrawing them. He did not object to 'B-Summary'."Her (victim) conduct warrants that she has misused the provisions of law which are meant for needy litigants," the court said. For her personal benefit and benefit, she has crossed every limit which all women have been following for decades. The judge also pulled up Kumar and a witness for filing an intervention petition in the case. The magistrate said that both had no grounds to appear and interfere in the matter and have crossed all limits by filing such a petition.Bhushan Kumar has no right to address the courtThe order said, "So far as Bhushan Kumar is concerned, he has no authority to address this court, but he has attempted to contest the matter which is unfortunate, immoral and unjustified." The magistrate said that these efforts show that he (Bhushan Kumar) wanted to get rid of the matter at the earliest. On the investigation conducted by the police, the court observed that the most striking feature of the case is that after registering the case, the investigating officers neither tried to arrest the accused nor the accused approached the court for anticipatory bail. Kiya, which signifies 'trust and commitment'.deal with various legal aspectsThe court said that on perusal of the report, it appears that various legal aspects have been compromised during the unforeseen investigation. The Investigating Officers of the case kept avoiding to investigate the matter properly. The court also noted that the report states that the victim used criminal law for her personal gain. It may be the case, she said, although the material on record indicates the offense of rape which can be proved by a good investigation." The court said that the investigating officers of the case have not done proper investigation and have tried to ignore the evidence available in the form of hotel records, CCTV footage and scientific investigation. The court directed the police to investigate the matter as per law. The court has also directed the Additional Public Prosecutor to take legal action against the victim who misused the law.Know what's the matterBased on a complaint by a 30-year-old woman, DN Nagar police had registered a case against Kumar in July last year under sections related to misbehavior and cheating of the Indian Penal Code. According to the complaint, Kumar (43) had allegedly misbehaved with the woman on the pretext of getting a job in his company.
