Maharashtra Politics: Politics is intense in Maharashtra, whose question is Shiv Sena? Today the Speaker is reading the verdict in the disqualification case of 16 MLAs of the party. On the other hand, before the decision, Maharashtra Chief Minister Eknath Shinde has given a big statement in Hingoli. Shinde has said that Shiv Sena's bow and arrows are with us, Bala Saheb's blessings are also with us. I am not a Chief Minister who sits at home. CM Shinde said that I just want to say that we have majority. There are 50 members in the Assembly i.e. 67% and 13 MPs in the Lok Sabha i.e. 75% and on this basis, the Election Commission has recognized us as the original Shiv Sena and allotted the Dhanush-Arrow election symbol. We hope the Speaker will pass us on merit."

Maharashtra Assembly Speaker Rahul Narvekar has come out of his chamber and gone to the Central Hall and is reading the decision. The speaker said that who is the real Shiv Sena is an important issue. Citing the Election Commission, he said that the Election Commission has considered only the Shinde faction as the rightful candidate for Shiv Sena. Shiv Sena has only one constitution with the Election Commission. No new constitution of Shiv Sena will be considered.

Maharashtra Assembly Speaker Rahul Narvekar said, “Looking at the evidence and records before me, prima facie indicate that no elections were held in the year 2013 as well as the year 2018. However, as the Speaker, I am exercising jurisdiction under Article 10. The jurisdiction of the Schedule is limited and it cannot go beyond the records of the ECI available on the website and hence I have not considered this aspect while determining the relevant leadership structure.

Thus, in view of the above findings, I find that the leadership structure of Shiv Sena as reflected in the letter dated 27 February 2018 available on the website of the ECI is the relevant leadership structure which should be taken into account for the purpose of determining whether Which group is the real political party..."
