Supreme Court stays HC order

The case of the recruitment of 69,000 assistant teachers in Uttar Pradesh has taken a new turn as the Supreme Court has stayed the Allahabad High Court's order. The court asked the state government and both parties to submit written arguments. During the hearing, CJI Chandrachud said that the High Court's decision will remain suspended for now, with the next hearing scheduled for September 25. He also instructed all concerned parties to present written submissions.

What did the Supreme Court say?

The CJI directed the government and both parties to present written arguments and said the court would conduct a final hearing on the matter. The court will examine the legal aspects of the case before issuing an order. The court needs time to study the High Court's decision, so for now, the High Court's order remains suspended.

The Supreme Court instructed both parties to submit their written arguments in a maximum of 7 pages each. The court also appointed two nodal advocates for this purpose. Meanwhile, the Uttar Pradesh government was directed to submit a response to the case.

What was the High Court's order?

It is noteworthy that the Allahabad High Court, in its decision, canceled the selection lists of June 2020 and January 2022 and directed the Uttar Pradesh government to issue a new selection list for 69,000 teachers based on the 2019 assistant teacher recruitment exam within three months.

The High Court also stated that if a reserved category candidate scores equal to the general category merit, their selection should be considered under the general category. Due to this order, a large number of teachers currently employed in Uttar Pradesh were facing the threat of losing their jobs.
