Winking and flying kisses while seeing someone also comes under the category of sexual harassment. The Pocso Court has sentenced a 20-year-old man accused of doing so to one year. Also, he has been fined Rs 15,000. The court said in its judgment that the accused youth, while looking at the minor, committed acts such as winking and kissing in the air, which could be considered as sexual harassment.

New Delhi: Winking and flying kisses while seeing someone also comes under the category of sexual harassment. The Pocso Court has sentenced a 20-year-old man accused of doing so to one year. Also, he has been fined Rs 15,000. The court said in its judgment that the accused youth, while looking at the minor, committed acts such as winking and kissing in the air, which could be considered as sexual harassment. The court also imposed a fine of Rs 15,000 on the accused, out of which Rs 10,000 will be given to the aggrieved party.

Had already done things in the past

According to a Times of India report, the 14-year-old victim told the court that on February 29, when she was going somewhere with her sister, the accused (Accused) living in the neighborhood looked at her and eyed her Kiss in the air on the other side. The accused had already committed such acts in the past and despite the explanation, there was no change in his behavior. The victim's mother told that the victim told her about the activities of the accused youth. He had asked the young man not to do so many times, but when he did not improve, a police complaint was lodged against him.

Defense's arguments rejected

During the hearing of the case, the defense counsel said that the allegations made by the girl and her mother should not be viewed as sexual harassment. The lawyer also alleged that the police did not properly investigate the case. However, the court ignored the defense pleas. The court said in its judgment that there is no such reason, so that it is clear that the victim has made wrong allegations. However, there is ample evidence that the accused has been asked many times to desist from such antics. The court further said that looking at someone with eyes or kissing in the air falls under the category of harassment.

Bet denied the allegations

The defense also alleged that there was a condition of Rs 500 between the victim's cousin and the accused. Due to this condition, the accused stared at him. However, the girl denied this charge in court. He told the court that the terms of the condition were completely wrong. The accused young man was constantly behaving in this manner. The defense repeatedly tried to prove in court that the arguments of the victim and her mother were not correct, but the court ruled in favor of the victim.
