Delhi / High court refuses to grant bail to Shahrukh Pathan in Delhi riots case

The Delhi High Court has dismissed the bail plea of Shah Rukh Pathan, who fired a pistol at a policeman during the riots that broke out in north-east Delhi in February 2020. New Delhi: The High Court on Friday refused to grant bail to accused Shah Rukh Pathan in a Delhi riot case. Pathan is accused of firing a pistol and firing at a head constable of the Delhi Police during the violence. The court rejected Pathan's bail plea, saying that the video clip that went viral about the incident has shaken the conscience of the court as to how it can take law and order into its own hands.

Justice Suresh Kumar Kait has said in the judgment that whether or not accused Shah Rukh Pathan intended to shoot the complainant police officer or any of the people present there with a pistol waving in the air, but it is quite difficult to believe That he did not know that what he was doing could harm someone's life. The court has said that it is not the case that the accused Pathan was not involved in the incident. The court has said that after considering all the circumstances, we have come to the conclusion that the lower court has rightly stated that it is accused of involvement in the violence and that the picture presented in this incident is screaming and giving testimony. . The High Court, in view of the seriousness of all the parties and the offense, said that the accused cannot be released on bail. Along with this, the court rejected the bail plea of ​​the accused. The court, after hearing all the parties, reserved its verdict on Pathan's bail plea.

Police opposes bail

Earlier, on behalf of accused Pathan, the advocate said that the investigation of the case has been completed and the trial will take a long time. The advocate also said that in such a situation there is no justification for keeping his client in jail. The Delhi Police, on the other hand, opposed the bail plea, saying that Pathan had a serious charge. Police said that the accused has not only been involved in the violence but has also tried to kill him by firing on the policeman who is handling law and order. The police had also said that the accused Pathan had played an important role in instigating the violence. Arguing this, the Delhi Police demanded the bail plea of ​​the accused be dismissed.

The lower court did not grant bail

The lower court had stated the nature of the allegations to be serious and said that the accused cannot be released on bail. The court had said that the accused has openly shot a pistol at the policeman and the video of his act has gone viral on social media. In February last year, 53 people died and more than 200 were injured in the violence in North East Delhi over the opposition to the CAA. In this case, the police arrested Pathan from Shamli in UP on March 3, 2020.
