A doctor who conducted medico-legal investigation on Hathras victim at AMU on September 22 had given "provisional opinion" that "there are signs of use of force". The report mentioned, based on details provided by her, that there was "complete" "penetration by penis" of "vagina". "However, opinion regarding penetrative intercourse is reserved pending availability of FSL reports", doctor had added.

HATHRAS: Contrary to the earlier claims made by the UP police ruling out the rape of the 19-year-old deceased dalit girl, the copy of the medico-legal investigation prepared by forensic experts of AMU’s Jawaharlal Nehru Medical College (JNMC) on September 22 clearly stated that on the basis of local examination of the patient, there were "signs of use of force ".

The report, which was prepared by forensic experts after the examination of the victim, states that semen was not found by the doctors. One of the doctors confirmed the use of force and stated, "Opinions regarding penetration and intercourse is subject to the pending availability of FSL reports."

According to page 23 of the report, there was complete penetration of the vagina, even as semen was not found in the body of the deceased. The doctors observed that the girl was unconscious at the time of the incident. 

"Pain during or after the incident", was also mentioned in the said report. The report, which has been signed by assistant professor of the forensic department, Dr Faiz Ahmed, states that the girl had alleged sexual assault by four men in her statement.

The report says that as per the details provided by the survivor, "she was sexually assaulted by 4 known persons of the same village when she was doing some work in the field at 9am. There is a history of loss of consciousness during the incident".

In a section of physical violence used by the accused, the report also mentions — based on details provided by the patient she was "gagged" and "strangulated by her duppata". The patient also informed the doctor that she was verbally threatened to be killed. She had mentioned names of accused - Sandeep, Ramu, Lovekush and Ravi - all in their 20s.

In fact the chairman of Neurosurgery department of the medical college professor MF HUDA had written a letter to the casualty medical officer of the emergency and the trauma centre of the hospital on September 22 stating that the patient is critical so "kindly arrange for magistrate for dying declaration".

The 54-page file has all records, including the admission report of the hospital, medico-legal report, treatment card.

The deceased who was allegedly gang-raped was rushed to district hospital Hathras on September 14 after the incident. She was then referred to Aligarh’s JNMC due to her critical condition. After a week, she recorded her statement on September 22 before a magistrate and said she had been raped. Following her statement, samples were sent to the forensic science laboratory, which received them on September 25.

The FSL report of Agra, however, stated that the woman was not raped. Relying on the FSL report, ADG (law and order) Prashant Kumar had said, "As per the report, no semen was found in the viscera sample".

The postmortem which was conducted at Safdarjung hospital in Delhi after the death of the girl on September 29 at 6.55am stated that the deceased's hymen showed "multiple old healed tears" and the "anal orifice showed old healed tear". The cause of death was mentioned in the autopsy report was due to trauma caused by the assault.
