What was said in the complaint?

Lawyer Hari Shankar Jain has demanded the disqualification of Hyderabad MP Asaduddin Owaisi, who took oath as a Lok Sabha member on June 25. He has complained to President Draupadi Murmu in this matter under Articles 102 and 103 of the Constitution of India. Let us know the main points of this complaint

• Asaduddin Owaisi raised the slogan of Jai Palestine from the stage immediately after taking oath.
• The letter states that Palestine is a foreign state and no citizen of India can owe allegiance to that state.
• The letter states that Article 102 of the Constitution of India provides for disqualification for any person to be elected as and to be a member of either House of Parliament if he is under an acknowledgement of allegiance or adherence to a foreign state.
• According to the complaint, Asaduddin Owaisi raised the slogan immediately after taking the oath to show that he owes allegiance to that state. This is a very serious matter and a threat to national security.
• Article 102 1(D) of the Constitution prohibits a person from becoming a member of Parliament if that person owes allegiance to a foreign state to safeguard the sovereignty and integrity of India.
• The letter also states that the slogan given by Owaisi in Parliament is a threat to the security, sovereignty and integrity of the country. This is a very serious issue which requires immediate attention and appropriate action.

Appeal to take the opinion of the Election Commission

The letter written to the President has demanded that Asaduddin Owaisi be disqualified under Article 102 1 (D) of the Constitution of India for having allegiance to a foreign state and raising the slogan Jai Palestine. Along with this, there is also a demand to consider the opinion of the Election Commission of India regarding the disqualification of Owaisi under Article 103 of the Constitution.
